Terms of Service

1. The Service

RandomSeed (“the Service”) is a browser-based creative studio that provides access to third-party AI media generation models through a spatial canvas interface. The Service is operated by RandomSeed (“we,” “us,” “our”). By using the Service, you agree to these Terms of Service (“Terms”). If you do not agree, do not use the Service.

The Service is provided “as is” and “as available.” We may update, modify, or discontinue features, models, or pricing at any time without prior notice.

2. Accounts

You must be at least 13 years old (or the minimum age required by your jurisdiction) to use RandomSeed. One account per person. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.

3. Credits & Payments

RandomSeed uses a prepaid credit system. Credits are consumed when you generate content. Credit costs vary by model, output type, and resolution. Credits do not expire. All credit purchases are final and non-refundable except where required by applicable law.

Payments are processed through our third-party payment provider, Polar. By purchasing credits, you also agree to Polar's terms of service.

4. Third-Party AI Models

RandomSeed acts as an interface to third-party AI generation models hosted by providers including, but not limited to, fal.ai. When you generate content, your prompts and inputs are sent to these third-party providers for processing. Each model and provider has its own terms of service, acceptable use policies, and licensing conditions.

We do not develop, train, or control the AI models available through the Service. We make no representations about the accuracy, reliability, safety, or legality of any model's outputs. Model availability, capabilities, and pricing may change at any time based on provider decisions outside our control.

5. Generated Content & Ownership

Subject to the terms of the underlying AI models, you retain rights to the content you generate using RandomSeed. You grant us a limited, non-exclusive license to store, process, and display your content within the platform solely to provide the Service.

Important: AI-generated content may not qualify for copyright protection in all jurisdictions. Laws regarding the copyrightability of AI-generated works vary and are evolving. We make no guarantee that content generated through the Service will be eligible for copyright registration or legal protection in any jurisdiction.

6. Commercial Use of Generated Content

You may use content generated through RandomSeed for personal and commercial purposes, including but not limited to marketing materials, social media, video production, music production, and product design, subject to the following conditions:

• Your use complies with the license terms of the specific AI model that generated the content. Model license details are displayed on each model's page on the upstream provider's platform.
• Your use complies with all applicable local, state, national, and international laws and regulations.
• You do not misrepresent AI-generated content as entirely human-created where such disclosure is required by law or platform policy.
• You accept sole responsibility for determining whether generated content is appropriate for your intended use, including verifying it does not infringe on third-party intellectual property rights.

7. AI-Generated Music

Music generated through the Service is produced by third-party AI models (currently CassetteAI and MiniMax Music). These models produce outputs described by their providers as royalty-free and commercially usable, subject to their respective terms.

You acknowledge and agree that:

• AI-generated music may contain inaudible watermarks or metadata embedded by the model provider for traceability and authenticity purposes.
• AI music models are trained on large datasets that may include copyrighted works. While providers design their models to generate original outputs, there is an inherent risk that generated music could resemble existing copyrighted compositions.
• You are solely responsible for verifying that generated music does not infringe on existing copyrights before publishing, distributing, or commercially exploiting it.
• We do not guarantee that AI-generated music will be accepted by content distribution platforms, streaming services, or content ID systems.
• Where required by applicable law or platform policy, you must disclose that music was generated using AI.

8. No Warranty of Originality or Non-Infringement

We do not warrant, represent, or guarantee that any content generated through the Service — including images, video, audio, music, or 3D models — will be original, unique, or free from third-party intellectual property claims. AI models may produce outputs that are similar to or derived from their training data.

You assume all risk associated with using generated content and are solely responsible for conducting appropriate due diligence (including, where applicable, reverse image searches, audio fingerprinting, or legal review) before using generated content in any context where originality or non-infringement is required.

9. Your Input

You retain ownership of the prompts, reference images, text, and other inputs you provide to the Service. By submitting inputs, you grant us and our third-party model providers a non-exclusive, royalty-free license to process those inputs solely for the purpose of generating your requested content.

You represent that you have the right to use any inputs you provide, including reference images and text. Do not submit content you do not have permission to use.

10. Acceptable Use

You agree not to use the Service to:

• Generate illegal, harmful, or abusive content
• Create deepfakes or impersonate real individuals without consent
• Generate content intended to harass, deceive, or defraud
• Produce content that exploits minors in any way
• Circumvent safety filters or usage restrictions on AI models
• Reverse engineer, scrape, or extract model weights or parameters
• Resell or sublicense direct access to AI models through the Service
• Use the Service in violation of any applicable law or regulation

We reserve the right to suspend or terminate accounts that violate these guidelines, without refund.

11. Indemnification

You agree to indemnify, defend, and hold harmless RandomSeed, its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Service; (b) your use or distribution of generated content; (c) your violation of these Terms; or (d) your violation of any third-party rights, including intellectual property rights.

12. Limitation of Liability

To the maximum extent permitted by applicable law, RandomSeed shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, or business opportunities, arising out of or related to your use of the Service or any generated content, regardless of the theory of liability.

Our total aggregate liability for any claims arising under these Terms shall not exceed the amount you have paid to us for credits in the twelve (12) months preceding the claim.

13. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or title. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that generated content will meet your requirements or expectations.

14. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason at our sole discretion. Upon termination, your right to use the Service ceases immediately. Unused credits are non-refundable upon termination for cause. Sections 5 through 13 survive termination.

15. Changes to These Terms

We may revise these Terms at any time by posting updated terms on this page. Material changes will be communicated via email or in-app notice. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

16. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be resolved exclusively in the courts located in Delaware.
